No word on Google Book Settlement
The
revised Google Book Settlement argument rambled on this week when the
judge hearing the case in a New York court told a February 18, 2010 oral
hearing that he would not rule at that day’s hearing
Manhattan federal court Judge Denny Chin did not specify when he would
issue a ruling. Instead he told those speaking for and against the settlement
and appearing before him that there is just too much to digest for an
early ruling.
US attorney William Cavanaugh told Chin that the settlement turned copyright
on its head.
Cavanaugh reportedly told the court that procedural rules cannot be used
to modify rights.
He also told the judge that the Department of Justice has an active, ongoing
antitrust investigation open on the settlement.
Google has digitized many millions of books without first getting the
permission of authors.
The proposed settlement is the result of a class action suit filed by
the Authors Guild and the Association of American Publishers five years
ago.
In late 2009, the original settlement was withdrawn in the face of over
400 objections from around the world, including the U.S. Department of
Justice and Copyright Office.
Chin is hearing argument on a revised settlement.
